Landowner Listing Agreement and Indemnity

READ THIS AGREEMENT CAREFULLY. IT SETS OUT YOUR OBLIGATIONS AS A LANDOWNER AND LIMITS THE PLATFORM'S LIABILITY TO YOU.

Parties

This Agreement is entered into between:

1. Gitwix Limited (the "Platform"), and 2. The registered Landowner User identified by the account to which this Agreement is linked (the "Landowner").

Part A — Authority and Ownership Declarations

By registering as a Landowner on the Platform, I hereby warrant and represent that:

A.1 I am the freehold or leasehold owner of any land I list on the Platform, or I have express written authority from the legal owner to grant permission for metal detecting on that land.

A.2 Where the land is tenanted or leased, I have obtained (or will obtain before confirming any Booking) the consent of any tenant or leaseholder to permit metal detecting activities.

A.3 The land I list is not a Scheduled Monument, Site of Special Scientific Interest (SSSI), World Heritage Site, National Trust property, Common Land subject to access restrictions, or any other land where metal detecting is prohibited or restricted by statute, designation, or agreement.

A.4 The land I list is not subject to any Countryside Stewardship, Higher Level Stewardship, or agri-environment agreement that prohibits or restricts metal detecting.

A.5 I will make honest, accurate, and complete disclosures about the land I list, including known hazards, boundaries, access conditions, and restrictions.

A.6 I have public liability insurance for the property (or will obtain appropriate cover) and I have notified (or will notify) my insurer that I am allowing third parties to access the property for metal detecting activities.

Part B — Occupier's Liability Acknowledgment

B.1 I acknowledge that, as the occupier of the Listed Land for the purposes of the Occupiers' Liability Act 1957, I owe a duty of care to Detectorists who are lawful visitors on my land pursuant to a confirmed Booking. This duty requires me to take reasonable care to ensure that visitors are reasonably safe for the purposes for which they are permitted to be on the land.

B.2 I acknowledge that this duty cannot be delegated to the Platform and that I am solely responsible for meeting this statutory duty.

B.3 I agree to:

• Disclose to Detectorists, before or at the time of Booking confirmation, all known hazards present on the land including but not limited to: unstable ground, hidden trenches, livestock, agricultural machinery, chemical treatments, water bodies, electric fencing, unexploded ordnance risk areas, and restricted zones;
• Provide an accurate map or boundary description of the permitted detecting area;
• Inform Detectorists of any changes to the land condition between Booking and the detecting date;
• Not knowingly grant access to land that is unsafe.

B.4 I understand that the Platform's facilitation of a Booking does not transfer my occupier's liability to the Platform.

Part C — Treasure Act Obligations

C.1 I acknowledge my obligations under the Treasure Act 1996, including that:

• I may be entitled to a share of any Treasure reward if a valid finds agreement is in place;
• I must cooperate with any Detectorist who reports a Treasure find and must not obstruct or delay reporting;
• If a Detectorist reports a potential Treasure find to me, I must ensure it is reported to the local Coroner and/or Finds Liaison Officer (FLO);
• I should keep records of all searches conducted on my land.

C.2 I acknowledge that the Platform has no role in Treasure reporting, valuation, or reward allocation and that these are entirely the responsibility of the relevant parties.

Part D — Finds Agreement Obligation

D.1 I acknowledge that under English law, I own all non-Treasure Finds made on my land unless I have entered into a written agreement with the Detectorist to the contrary.

D.2 I will ensure that any agreed split of Finds is set out clearly in the Search Agreement before any Booking is confirmed.

D.3 I understand that the Platform's standard Search Agreement template is a starting point only and that I should seek legal advice if I require a bespoke arrangement.

Part E — Indemnity to the Platform

E.1 I agree to fully indemnify, defend, and hold harmless Gitwix Limited, its directors, officers, employees, agents, contractors, successors, and assignees (the "Released Parties") against any and all claims, demands, actions, proceedings, damages, losses, costs, and expenses (including reasonable legal fees) brought by any third party (including any Detectorist) arising out of or in connection with:

• Any breach of my obligations under the Occupiers' Liability Act 1957 or 1984 in respect of a Detectorist or any other person entering my land pursuant to a Booking;
• Any personal injury or death suffered by a Detectorist or any third party on my land;
• Any misrepresentation I make regarding the nature, ownership, or restrictions applicable to my Listed Land;
• My listing of land that is a Scheduled Monument, SSSI, or otherwise legally restricted site;
• Any dispute regarding Finds ownership arising from my failure to set out a clear Finds agreement;
• My breach of any obligations under the Treasure Act 1996;
• Any failure to disclose known land hazards;
• My breach of any agri-environment or Countryside Stewardship agreement.

Part F — Acknowledgment and Signature

By clicking "I ACCEPT" on the Platform during registration, the Landowner confirms that:

1. They have read and understood this entire Agreement; 2. They have had the opportunity to seek independent legal advice; 3. All representations and warranties made herein are true and accurate; 4. They understand that this Agreement is recorded electronically and forms part of their binding contractual arrangement with the Platform.
